PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. All purchases and deliveries exclusively take place on the basis of these general terms and conditions. Deviating rules apply only after previous confirmation in writing by The Wildes. If you do not agree to these terms and conditions, please do not use this site.
1. General
Many of our products offered are manufactured by small companies and individuals. Hence many of our items are limited "small editions". Therefore some items might be sold out very fast.
2. Order and Contract Conclusion
The order of the customer is as per the offer until the conclusion of the sales contract. It finalises with the delivery of the order by The Wildes to the customer. The contract arises from acceptance of the order. The acceptance of an order can be stated orally, in writing or with the final delivery of the ordered items. We deliver items in stock within 2 weeks. If an item is not available, or not in stock, we will let you know the soonest possible date of delivery or that the delivery cannot proceed.
3. Prices
All given prices originate in Australian dollars. Postage and packaging costs are added according to the payment conditions separately. The prices on the website are valid always.
4. Delivery
All delivery dates mentioned are in principle noncommittal. The Wildes are not responsible for customs duties or taxes for deliveries outside of Australia. The customer is to bear these costs. In the case where a package cannot be delivered, no further delivery will take place without the up-front payment of any additional expenses.
5. Conditional Sale
Until payment of the full purchase price is completed, all items remain the property of The Wildes.
6. Warrantee
If for any reason you are not happy with the item you may return it via post within 60 days of purchase. If the goods are faulty, The Wildes are first authorised to supply a replacement to the same expense. In the case of a complaint, the receipt is required to prove the date of purchase. The reclaimed item and a copy of the receipt are to be sent to: The Wildes, 9 St Aubin Street, Beaumaris, 3193, VIC, Australia. The warranty is not valid for any usual wear out or abrasion, or normal irregularities as part of the finishing and design. The warranty expires if the customer has changed the delivered product(s).
Please follow the washing instructions that you can find on the article's label. We do not assume liability for damages caused by false cleaning.
7. Right of Cancellation and Returns
The Wildes do not assume liability for possible damages that are caused by the use of the purchased items, especially when used improperly.
Compensation demands are impossible, except if damages were caused premeditatedly or by gross negligence. It is not valid for sealed goods if you opened the packaging or have damaged it. In the case of cancelled orders and returned articles, we reimburse only after receipt of goods by The Wildes. The time for the of processing of refunds is approximately 20 working days. In case of returned items that have been damaged or used, The Wildes reserve all rights to demand compensation. It is not allowable to damage or remove original labels on an item that is to be returned.
8. Accounts, passwords and security
Certain features or services offered on or through the site may require you to open an account. You are entirely responsible for maintaining the confidentiality of your account information, including your password, and for any and all activity that occurs under your account. The Wildes must be notified immediately of any unauthorised use of your account or password, or any other breach of security. You may be held liable for losses incurred by The Wildes, or any other user/visitor to the site, due to someone else using your password or account.
You may not use anyone else's password or account at any time without the express permission and consent of the holder of that password or account.
The Wildes cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.
9. Applicable Law
The Australian Federal Rules and Laws apply to all disputes between parties resulting from the sale or delivery of goods, even if the buyer does not reside in.
10. Severability
In case one of these clauses should be or becomes void, the validity of the other clauses remains intact.
